1. Acceptance of Terms

By accessing and using the services provided by Apex Auto Service Center ("we," "us," "our"), you accept and agree to be bound by the terms and provision of this agreement. These terms of service govern your use of our automotive repair and maintenance services, as well as our website and any related services.

If you do not agree to abide by the above, please do not use our services. We reserve the right to change these terms and conditions at any time without notice. Your continued use of our services following any such changes constitutes your acceptance of the new terms of service.

2. Service Description

Apex Auto Service Center provides professional automotive maintenance and repair services for passenger cars and light commercial vehicles in accordance with industry standards. Our services include but are not limited to:

  • Engine diagnostics and repair
  • Brake system maintenance and repair
  • Oil changes and lubrication services
  • Tire installation and wheel services
  • General automotive maintenance and inspections
  • Transmission services
  • Electrical system diagnostics and repair

All services are performed by certified technicians using industry-standard equipment and procedures. We strive to maintain the highest quality standards in all our work.

3. Appointments and Service Scheduling

Service appointments can be scheduled by phone, email, or through our website contact form. We recommend scheduling appointments in advance to ensure timely service. Walk-in services may be accommodated based on availability.

In case you need to cancel or reschedule an appointment, please provide at least 24 hours notice. Failure to provide adequate notice may result in a cancellation fee. We reserve the right to reschedule appointments due to unforeseen circumstances, emergency repairs, or equipment issues.

4. Pricing and Payment Terms

All service prices are quoted in Canadian dollars and include applicable taxes unless otherwise specified. Labor rates, parts pricing, and service fees are subject to change without notice. A detailed estimate will be provided before any work begins on your vehicle.

Payment is due upon completion of services unless other arrangements have been made in advance. We accept cash, credit cards, and debit cards. For extensive repairs, we may require a deposit before beginning work. All outstanding balances must be settled before vehicle release.

5. Customer Responsibilities

Customers are responsible for providing accurate information about their vehicle's condition, service history, and any known issues. You must disclose any aftermarket modifications or previous repair work that may affect our service.

Customers must remove all personal items from vehicles before service. Apex Auto Service Center is not responsible for lost, stolen, or damaged personal property left in vehicles. We recommend removing all valuables before dropping off your vehicle.

You are responsible for maintaining current insurance coverage on your vehicle while it is in our possession for service or repair.

6. Warranties and Disclaimers

We provide warranties on our workmanship and parts as follows:

  • Labor warranty: 90 days or 5,000 kilometers, whichever comes first
  • Parts warranty: As specified by manufacturer, typically 12 months
  • Oil change services: 30 days or as recommended by manufacturer

Warranty coverage is void if the vehicle is damaged due to abuse, neglect, accident, or improper use. Warranty work must be performed at our facility. We are not liable for consequential damages or indirect costs resulting from service failures.

All services are provided on an "as is" basis. We make no warranties beyond those expressly stated above.

7. Limitation of Liability

Our liability for any claim arising from our services is limited to the cost of the specific service performed. We are not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of use, loss of income, or rental car expenses.

In no event shall our total liability exceed the amount paid for the services in question. This limitation applies regardless of the legal theory on which the claim is based, whether contract, tort, negligence, or otherwise.

8. Vehicle Storage and Lien Rights

Vehicles left on our premises for more than 30 days after completion of service or abandonment may be subject to storage fees. We reserve the right to place a mechanic's lien on any vehicle for unpaid charges.

After 60 days, vehicles with outstanding balances may be sold to recover costs in accordance with applicable provincial laws. Customers will be notified by registered mail before any lien action is taken.

9. Privacy and Data Protection

We respect your privacy and handle your personal information in accordance with our Privacy Policy. By using our services, you consent to the collection and use of your information as described in our privacy policy.

We maintain service records for warranty and regulatory purposes. Customer information may be shared with parts suppliers, manufacturers, or regulatory authorities as required for warranty claims or legal compliance.

10. Environmental Responsibility

Apex Auto Service Center is committed to environmental protection. We properly dispose of automotive fluids, batteries, tires, and other materials in accordance with environmental regulations. Used oil and filters are recycled through certified programs.

We use environmentally responsible products and procedures whenever possible and encourage customers to participate in proper disposal of automotive waste.

11. Dispute Resolution

Any disputes arising from these terms or our services shall be resolved through binding arbitration in accordance with the laws of Alberta, Canada. The arbitration shall take place in Calgary, Alberta.

Before pursuing arbitration, we encourage customers to contact us directly to resolve any concerns. Most issues can be resolved through direct communication and our commitment to customer satisfaction.

12. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, labor disputes, equipment failures, supply chain disruptions, or government regulations.

13. Governing Law

These terms of service are governed by and construed in accordance with the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any legal proceedings shall be subject to the jurisdiction of the courts of Alberta.
